8. SUBSCRIPTIONS AND CANCELLATION

  • Enrollment: Subscriptions are automatically billed and shipped at your chosen frequency (e.g., every 30 days) until canceled.
  • 30-Day Money-Back Guarantee: This guarantee applies only to first-time orders within 30 days of receipt.
  • Renewal Refund Policy: There are no refunds on subscription renewal orders.
  • Cancellation Deadline: You must cancel your subscription twenty-four (24) hours prior to the creation of your next order. Failure to cancel within this window will result in the order being processed, charged, and shipped.
  • By placing your monthly recurring order of MoldMD - you will be charged 39.95, now and every 4 weeks thereafter until you cancel your subscription. You will receive an electronic notification 5 to 7 days prior to your transaction and receipt after each successful transaction.

9. SHIPPING AND RISK OF LOSS

Shipping times are estimates only. Risk of loss and title for all products pass to you upon our delivery to the carrier. Any delivery confirmation provided by the carrier is deemed sufficient proof of delivery.

10. USER TESTIMONIALS AND SUBMISSIONS

By submitting feedback, reviews, or photographs, you grant MoldMD a royalty-free, worldwide, perpetual, and transferable right to use, publish, and adapt such submissions for any purpose, including advertising.

11. DISCLAIMER OF WARRANTIES

EXCEPT WHERE PROHIBITED BY LAW, THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE RESULTS OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE.

12. LIMITATION OF LIABILITY

EXCEPT WHERE PROHIBITED BY LAW, IN NO EVENT SHALL MOLDMD OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. IF MOLDMD IS FOUND LIABLE UNDER ANY THEORY, OUR TOTAL LIABILITY AND YOUR EXCLUSIVE REMEDY WILL BE LIMITED TO USD $300.00.

13. REFUND AND RETURN POLICY

13.1 Damaged or Incorrect Items If you receive a damaged, defective, or incorrect product, please contact us immediately at support@moldmd.com. You do not need to return the damaged item—we will send a replacement at no cost to you once the damage is verified.

13.2 30-Day Money-Back Guarantee (First Order Only) As outlined in Section 8, a full refund of the purchase price is available only for your first-time subscription order within thirty (30) days of receipt and if the product is not damaged. Opened & used products are still eligible to return within the 30 day period. To initiate this, email support@moldmd.com with your order number.

13.3 Subscription Renewal Orders In accordance with our subscription terms, there are no refunds on any subscription renewal orders. It is the customer's responsibility to cancel at least twenty-four (24) hours before the order is created to avoid charges.

13.4 Exchanges To exchange an item, please return the original item in accordance with this policy. Once the return is accepted and processed, you may place a new order for the replacement item.

13.5 Shipping Costs

  • Non-Refundable: All shipping costs are non-refundable.
  • Multi-Unit Orders: If a return is approved for a multi-unit order, MoldMD may, at its discretion, cover return shipping for unopened items on first-time purchases only.
  • Customer Responsibility: For all other returns, including any authorized subscription returns, return shipping costs are the sole responsibility of the customer.

13.6 Return Instructions To initiate a return:

  1. Email support@moldmd.com with your order number and the specific reason for your return.
  2. We will provide specific return instructions and, if applicable, a return shipping label.
  3. Items must be sent back to the address provided.
  4. Products returned without prior written authorization may not be accepted or eligible for refund.

13.7 Holiday Delivery Notice Due to high seasonal demand, we cannot guarantee delivery before December 25th for any orders placed after December 1st. Please place orders early to avoid carrier delays.

13.8 Policy Amendments MoldMD reserves the right to update or amend this Refund and Return Policy at any time without prior notice. Changes take effect immediately upon publication on the Website.

13.9 Acknowledgment of Policy By placing an order with MoldMD, you acknowledge and agree to the terms outlined in this Refund & Return Policy and the $300.00 Limitation of Liability described in Section 12

14. DISPUTE RESOLUTION BY MANDATORY BINDING ARBITRATION

  • Mandatory Arbitration: Any dispute or claim arising from these Terms or your use of the Website shall be submitted to binding, confidential arbitration before a single arbitrator administered by the American Arbitration Association (AAA).
  • Class Action Waiver: You agree that you may only bring claims against us in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
  • Opt-Out: You may opt out of arbitration within 30 days of your first purchase by sending a written notice to our business address.

15. INDEMNIFICATION

You agree to indemnify and hold harmless MoldMD and its affiliates from any claims, damages, or expenses (including attorneys' fees) arising from your breach of these Terms or your violation of any law.

16. GOVERNING LAW

These Terms are governed by the laws of the State of Massachusetts. For any matters not subject to arbitration, you agree to the exclusive jurisdiction of the courts located in Delaware.

17. TERMINATION

We may terminate your access to the Services at any time for any reason without notice. Sections regarding liability, arbitration, and intellectual property shall survive termination.
